COVID – 19 Damages

In light of the COVID-19 crisis, many of us have found ourselves without income. Businesses have been forced to close and salaried workers have been furloughed (placed on unpaid leave). This raises two important questions. First, does your insurance cover the damages due to the losses that are a direct/indirect result of the crisis and of government decisions (or the lack of such decisions) regarding the crisis?
The answer is, definitely, yes!
Things may vary, of course, from contract to contract (and the same applies to an insurance policy). Attorneys, however, have many tools to work with on these issues – especially in our firm, which specializes in contractual matters that are a combination of contractual and damage issues. From a contractual viewpoint, anything written or not written in an agreement must be construed reasonably; however, where there are a number of possibilities, the contract will be construed against the drafter. Since the insurance companies are the ones who draft insurance policies, the contract must be construed against them, as they controlled the way in which the agreements are viewed.
Second, whether you can obtain financial compensation from the state should be explored. We can represent you against the different bodies and institutions responsible for government payments and, especially, payment compensation for disability and loss of income. That is, because of a period of isolation or a requirement to remain at home, the state does not allow you to earn a living, these monies can be recovered, fully or partially, from the National Insurance Institute (Bituach Leumi) or other agencies, according to your status (soldier, government employee, self-employed, etc.).

Medical Malpractice

Medical malpractice cases receive special attention in our firm. These cases involve individuals who go to various branches of the medical system, in order to obtain relief from pain and illness. Unfortunately, they leave the system injured and battered, due to the malpractice of the medical team that treated them. It should be noted that included in the medical team are nurses, interns, x-ray technicians, etc. – not only doctors. In addition, proof of mens rea, the intention or knowledge of wrongdoing on the part of the medical team, is not required. In order to establish a medical malpractice lawsuit, it is enough to prove that the doctor did not perform as a “reasonable physician” or that he/she acted negligently. It is also necessary to prove that the injury caused to the plaintiff was as a result of that negligence. After decades of experience, we can state with pride that whenever we decided that there was room to submit a lawsuit, our clients were well-compensated. Moreover, no medical malpractice lawsuit that we have submitted has ever been rejected.
